Rights and responsabilities

Welcome to the Jazzserver. The Jazzserver is a registered trademark owned by De Jazz Organisatie (The Jazz Organiation hitherto named as the JO). The following are the rules or "Terms" that govern use of the Jazzserver. By clicking the "I agree" button, you state that you are eligible for an account and that you agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Jazzserver. The JO reserves the right to change these Terms at any time, effective immediately upon posting on the site.

Member account, password and security
To open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the Registration Wizard and by choosing a password and a login name. You are entirely responsible for maintaining the confidentiality of your login and password. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify the Jazzserver immediately of any unauthorized use of your account or any other breach of security.

Permitted use
As a member you have the opportunity to upload "content" (i.e. music samples, photographs, articles, links or other material) to the Jazzserver for the purpose of promoting a band, venue, festival or other musical event. If you create an account on behalf of a third party and/or publish content of which you are not the copyright holder, you agree to do so only with the express permission of the rightful copyright holder.

You are only authorized to view and to retain a copy of pages of this site for your own personal use. Do not duplicate, publish, modify or otherwise distribute the material on this site unless specifically authorized by The JO to do so. The content and software on this site are the property of The JO and/or its members and are protected by Dutch and international copyright laws. Any unauthorized commercial use or resale of this content and software is expressly prohibited.

You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur through your account or password, including the content of your transmissions.

By way of example, and not as a limitation, you agree not to:

  • Transmit or upload any content or information that you know is false or misleading.
  • Transmit or upload any content or information that is or promotes an illegal or unauthorized copy of another person's work, such as pirated music or links to pirated music files, pirated computer programs or links to them, or information to circumvent manufacture-installed copy-protect devices.
  • Publish, distribute or disseminate any inappropriate, profane, defamatory, infringing, libelous, obscene, indecent or unlawful material or information.
  • Duplicate, distribute or engage in any commercial use of the content or software on the Jazzserver without the express written consent of The JO.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent, or provide content that involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming".
  • Transmit or upload any content or information that contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page), or any content that solicits passwords, personal identifying information for commercial or unlawful purposes from members or visitors of the Jazzserver.
  • Transmit or upload any material that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs; or any material that contains instructional information about providing or creating such.
  • Attempt to gain unauthorized access to the Jazzserver, other accounts, computer systems or networks connected to the Jazzserver, through password mining or any other means.
  • Interfere with, disrupt or violate the regulations, policies or procedures of the Jazzserver or of networks connected to the Jazzserver.

Violation of the Terms
You understand and agree that in The JO's sole discretion, and without prior notice, The JO may terminate your access to the Jazzserver and remove any content, if The JO believes that the content you provided has violated or is inconsistent with the terms or with the intention behind them, or that you have violated the rights of The JO, another member or the law. The JO may release member information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity.

Member inactivity
The Jazzserver may also terminate your account for inactivity, which is defined as failing to log into the Jazzserver for an extended period of time, as determined by the Jazzserver. A first log-on must occur within 10 days after registration. Subsequent log-ons must occur no later than 180 days since your last log-on. Upon termination of your account, your right to use member priviliges immediately ceases.

Liability
The JO is not liable or responsible for any content provided by members. This content cannot be previewed by The JO before it appears and it does not necessarily represent the view or opinions of The JO. Members can be held liable for any illegal or prohibited user content they provide to the site, including among other things, infringing, defamatory or offensive materials. Should you discover this kind of material on the site, please notify us at info@muziekentheaternetwerk.nl. We will investigate your claim and take appropriate action.

The Jazzserver may automatically produce search results that reference or link to third party sites throughout the World Wide Web. The JO can not guarantee, represent or warrant that the content contained in these sites is accurate, legal and/or inoffensive. The JO does not endorse the content of any third party site, nor do/can we warrant that they will not contain viruses or otherwise impact your computer. By using the site to search for or link to another site, you agree and understand that you may not make any claim against The JO for any damages or losses, whatsoever, resulting from your use of the Jazzserver to obtain search results and/or to link to another site. However, if you have a problem with a link on the Jazzserver, please let us know at info@jazzserver.org, and we will investigate the link and take appropriate action.

The JO does not promise that the Jazzserver will be error-free, uninterrupted, nor that it will provide specific results from use of the site or any content, search or link on it. The site and its content are delivered on an "as-is" and "as-available" basis. The JO can not ensure that files you download from the site will be free of viruses or contamination or destructive features. The JO disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. The JO will not be liable for any damages of any kind arising from the use of this site, including without limitation, direct, indirect, incidental, punitive and consequential damages.

Privacy
We believe that your privacy and the privacy of all our users is important and we make every effort to ensure that your personal information remains confidential. However, if you post any original content to the site, by electronic mail or otherwise, we will treat it as non-confidential and non-proprietary to you. By posting it to the site, you authorize us to use or allow others to distribute, reproduce or otherwise use the content. The JO is not liable for any lost data resulting from the operation of our site and/or the enforcement of the terms. We urge all users to maintain their own back up versions of any content they submit to the site.

Disputes
If there is any dispute about or involving the Jazzserver, by using the Jazzserver, you agree that the dispute will be governed by the laws of The Netherlands without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and courts of The Netherlands.

Indemnity
You agree to indemnify and hold The JO, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Jazzserver, including also your use of the site to provide a link to another site or to upload content or other information to the site.

The Jazzserver may terminate your access to any part or all of the Service at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever.
